By accessing or using SpinDeck ("the Service"), you agree to be bound by these Terms of Use and End User License Agreement ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and SpinDeck.
SpinDeck is a web-based fortune wheel designer and builder that allows users to create, customize, and operate interactive spinning wheel experiences. The Service is provided "as is" and may include both free and paid tiers of functionality.
Subject to these Terms, SpinDeck grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service or any portion thereof.
Certain features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. SpinDeck is not liable for any loss or damage arising from your failure to maintain the security of your account.

The Service and its original content, features, and functionality are and will remain the exclusive property of SpinDeck and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SpinDeck.
Content you create using the Service (your wheel designs, segment labels, etc.) remains your property. By using the Service, you grant SpinDeck a limited, worldwide, royalty-free license to host, store, and display your content solely to the extent necessary to provide the Service to you.
The free tier of the Service includes up to 10 spins per day, tracked via your browser's local storage. These limits are subject to change at any time. Circumventing free tier limits (e.g., by clearing storage to reset counters) is prohibited and may result in suspension of your access.
Paid subscription plans, where available, grant access to additional features as described at the time of purchase. Subscription fees are billed in advance on a recurring basis. All fees are non-refundable except as required by applicable law. We reserve the right to modify subscription pricing with reasonable advance notice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SPINDECK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, SPINDECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF SPINDECK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SPINDECK'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date above and, where appropriate, by notifying you via email or an in-app notice. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
